Terms of Service

Welcome to Stickitona! These Terms of Service (“Terms”) govern your use of the website stickitona.com and all related services (“Service”) operated by van Yperen, based in the Netherlands (“we,” “us,” or “our”).

By using our Service, you agree to these Terms. If you do not agree, please do not use our Service.

1. What We Do

Stickitona is a print-on-demand merchandise platform. You can upload, create, or generate designs and place them on products (mugs, t-shirts, stickers, phone cases, tote bags) for purchase. Each product is custom-made to order by our fulfillment partner and shipped directly to you.

2. Accounts

• You may create an account using your email, Google, or Apple sign-in.
• You may also use our Service as a guest without creating an account.
• You are responsible for keeping your account credentials secure.
• You must be at least 16 years old to use our Service.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Orders and Pricing

• All prices are displayed in EUR (or your local currency equivalent) and include applicable taxes where required.
• By placing an order, you are making a binding offer to purchase the selected products.
• We confirm your order by sending a confirmation email. The contract is formed at this point.
• Prices may change at any time, but changes will not affect orders already confirmed.

4. Payment

• Payments are processed securely by Stripe.
• We accept the payment methods displayed at checkout.
• Payment is collected at the time of order.
• If payment fails, your order will not be processed.

5. Custom Products: Refunds and Cancellations

Because every product is custom-made to order, the following applies:

• No right of withdrawal on custom items: Under EU Directive 2011/83/EU, Article 16(c), the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalized. Since every Stickitona product is custom-printed with your chosen design, you cannot cancel an order once production has begun.
• Defective or damaged products: If your product arrives damaged, defective, or significantly different from what you ordered, contact us within 14 days of delivery. We will offer a replacement or full refund at our discretion.
• Wrong item shipped: If you receive the wrong product, contact us and we will send the correct item or issue a refund.
• Non-delivery: If your order does not arrive within the estimated delivery window, contact us. We will investigate with our fulfillment partner and either reship or refund the order.
• Quality issues with the design/print: If the print quality is demonstrably poor (misaligned, faded, smudged), we will replace the item or refund you.

To request a refund or report an issue, email support@stickitona.com within 14 days of receiving your order, including your order number and photos of the issue.

6. Shipping and Delivery

• Products are printed and shipped by our fulfillment partner, Gelato, from the production facility nearest to your shipping address.
• Estimated production time is 2–5 business days. Shipping time varies by destination (typically 3–8 business days for EU, 5–14 business days internationally).
• These are estimates, not guarantees. We are not responsible for delays caused by carriers, customs, or events beyond our control.
• Shipping costs are calculated and displayed at checkout before you complete your order.
• Risk of loss passes to you upon delivery by the carrier.

7. Your Content and Intellectual Property

Your designs

• You retain full ownership of any designs, images, or artwork you upload to Stickitona.
• By uploading content, you grant us a limited, non-exclusive license to use your designs solely for the purpose of producing and delivering your ordered products. We will not use your designs for any other purpose.
• You are solely responsible for ensuring your designs do not infringe on any third-party copyrights, trademarks, or other intellectual property rights.

Your responsibility

You represent and warrant that:

• You own or have the legal right to use any content you upload.
• Your content does not infringe any third-party intellectual property rights.
• Your content does not contain illegal, defamatory, obscene, or hateful material.
• Your content does not impersonate any person or entity.
• Your content does not violate any applicable laws.

Prohibited content

You may not upload or generate designs that:

• Infringe copyrights or trademarks (e.g., logos, characters, or artwork you do not own).
• Contain hate speech, threats of violence, or discriminatory content.
• Depict illegal activity.
• Contain pornographic or sexually explicit material.
• Impersonate brands, organizations, or public figures in a misleading way.
• Violate export control or sanctions laws.

We reserve the right to refuse production, remove content, or cancel orders that violate these rules, without refund.

Indemnification

You agree to indemnify and hold van Yperen harmless from any claims, damages, losses, or expenses (including legal fees) arising from your content or your violation of these Terms, including any intellectual property infringement claims from third parties.

8. AI-Generated Designs

• Our Service offers AI image generation powered by third-party providers.
• AI-generated images are created based on your text prompts.
• Ownership: To the extent permitted by applicable law, you may use AI-generated images created through our Service for personal and commercial use on Stickitona products. However, the legal status of AI-generated content ownership varies by jurisdiction and is evolving. We make no guarantee that AI-generated images qualify for copyright protection in any jurisdiction.
• No guarantee of uniqueness: AI models may generate similar images for different users with similar prompts. We do not guarantee that your AI-generated design is unique.
• Your responsibility: You are responsible for reviewing AI-generated images before placing an order. You are responsible for ensuring AI-generated designs do not resemble existing copyrighted or trademarked works.
• Content restrictions: The same prohibited content rules (section 7) apply to AI-generated content. Do not use prompts intended to generate infringing, illegal, or harmful content.
• Disclaimer: We are not liable for any AI-generated content that inadvertently resembles existing works or that is deemed inappropriate. AI systems can produce unexpected results.

9. Cross-Platform Artwork (Muurly)

• Some designs may originate from the Muurly platform (muurly.com) via the “Stick it on a...” feature.
• These artworks are provided by artists who have agreed to make them available for merchandise.
• The original artist retains copyright and earns a commission on merchandise sales.
• You may not extract, copy, or redistribute these artworks outside of purchasing merchandise on Stickitona.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our Service is provided “as is” and “as available.”
• We do not guarantee uninterrupted or error-free service.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• Our total liability for any claim arising from your use of the Service is limited to the amount you paid for the specific order in question.
• We are not liable for any actions or failures of our third-party service providers (Stripe, Gelato, FAL.AI) beyond making reasonable efforts to resolve issues on your behalf.

This limitation does not affect your statutory rights as a consumer under EU law, including mandatory consumer protection provisions that cannot be waived by contract.

11. Availability and Changes

• We may modify, suspend, or discontinue any part of the Service at any time.
• We may update these Terms from time to time. Material changes will be announced on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
• We will make reasonable efforts to provide notice before significant changes take effect.

12. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Upload malware, viruses, or malicious code.
• Scrape, crawl, or use automated tools to extract data from our Service.
• Interfere with the proper functioning of the Service.
• Resell or commercially exploit the Service itself (this does not restrict your use of products you purchase).

13. Governing Law and Disputes

• These Terms are governed by the laws of the Netherlands.
• For EU consumers: You retain the protection of mandatory provisions of the law of your country of residence. Nothing in these Terms affects your statutory consumer rights.
• Any disputes that cannot be resolved amicably will be submitted to the competent courts in the Netherlands.
• EU consumers may also use the European Online Dispute Resolution (ODR) platform to resolve disputes online.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and van Yperen regarding the use of Stickitona.
